ENTRY PERIOD: The win a $100 Gift Certificate to Gander Mountain© ("Sweepstakes) beings at 12:00:01 am Eastern Daylight Savings Time ("EDT") on September 27, 2010 and ends at 11:59:59 pm EDT on October 31, 2010 ("Sweepstakes Entry Period"). Sweepstakes is sponsored by BLASTmedia, PO Box 6270, Fishers, IN 46038, USA.
SWEEPSTAKES ELIGIBILITY: Sweepstakes participation is open only to legal U.S. residents of the 50 United States who are 18 years of age or older at the time of entry. Employees of BLASTmedia ("Sponsor" or “BLASTmedia”) and their respective affiliates, subsidiaries, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (all of the foregoing, together with Sponsor, collectively referred to as "Sweepstakes Entities"), and the immediate family members (spouse, and parents, siblings and children, regardless of where they live) and persons living in the same household as such individuals, whether related or not, are not eligible to participate or win. Void in any state and where prohibited or restricted by law. All federal, state and local laws and regulations apply.
HOW TO ENTER: To enter the Sweepstakes, visit www.GPSTuner.com/iphone during the Sweepstakes Entry Period and sign-up via email registration on the Webpage at www.GPSTuner.com/iphone. To qualify for one Sweepstakes entry, participants must follow the online instructions to complete the official $100 Gift Certificate to Gander Mountain© entry form, including your valid e-mail address. If you are notified that you have won, we will require your full name, complete address, daytime telephone number and date of birth. All online entries must be received by 11:59:59 pm EDT on October 31, 2010 to be eligible to win. Limit one entry per person and per e-mail address. Sponsor's computer is the official time keeping device for this Sweepstakes. Any attempt to submit more than the maximum number of entries using multiple/different email addresses, identities or any other methods may void that participant's entry. If there is a dispute about the legal owner of the email address or entry, the authorized subscriber of the e-mail account used to enter the Sweepstakes at the actual time of entry will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain name associated with the submitted e-mail address. No automatic, programmed, robotic or similar means of entry are permitted, and individuals engaging in such practices will be disqualified. The use of automated or third-party software to enter is prohibited. No groups, clubs or organizations may reproduce or distribute any portion of these Official Rules to its members. All entry information becomes the property of Sponsor and will not be acknowledged or returned.
No responsibility is assumed by Sponsor for lost, late, misdirected, or illegible entries or for any human, computer, online, telephone, or technical malfunctions that may occur, or for any printing or typographical errors in any materials associated with the Sweepstakes.
PRIZE: The winner will receive One (1) $100 Gift Certificate to Gander Mountain©. A second and third place winner will each receive One (1) $50 Gift Certificate to Gander Mountain. Two (2) $50 Gift Certificates to Gander Mountain will be awarded in total. No transfer, substitution or cash equivalent of prize is permitted except that Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize is unavailable. BLASTmedia will not accept any responsibility for the warranty of the prize. As such, the winner will be required to contact the product’s manufacturer to pursue any and all product claims. All federal, state and other taxes on prize are the sole responsibility of each winner. See Prize Restrictions/Conditions below. Odds of winning a prize depend on the total number of eligible entries received. LIMIT ONE PRIZE PER PERSON OR HOUSEHOLD.
PRIZE CONDITIONS/RESTRICTIONS: Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from receipt of the prize are the sole responsibility of the winner. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded.
RANDOM DRAWING: The prize winner will be selected in a random drawing on or about Novemberber 1, 2010 from among all eligible entries received. The drawing will be conducted and the prize winner will be randomly selected by an electronic software program. The decision will be final and binding in all matters relating to this Sweepstakes.
PRIZE NOTIFICATION/WINNER VERIFICATION: The prize winner will be notified by email, at the email address provided at the time of entry. The winner will be required to complete and return an Affidavit of Eligibility/Liability Release and, except where prohibited by law, a publicity release within seven days of the email date on the prize notification. A selected winner will forfeit the prize and an alternate winner will be selected from all remaining eligible entries received if (i) such selected winner fails to return required documents in a timely manner, (ii) any prize/prize notification is returned as undeliverable, (iii) the Sweepstakes Entities are unable to contact the selected winner, (iv) the selected winner is otherwise found to be ineligible, or (v) the selected winner cannot accept or receive the prize for any reason. If any prize winner is a minor, prize will be awarded to the winner's parent or legal guardian. Allow 6-8 weeks for delivery of prize following completion of the notification process. Prize will only be delivered to addresses within the United States and verified signature for delivery will be required.
By accepting the prize, the prize winner consents to the use of his/her name, photograph, voice, quotes and/or likeness for advertising/publicity purposes in commerce and in any and all media worldwide without limitation or additional compensation, except where prohibited by law. Each winner's first initial, last name, city and state will be disclosed by BLASTmedia and will be distributed upon request and as required by law.
The prize winner, by entering and accepting a prize, acknowledges compliance with and agrees to be bound by these Official Rules and agrees to release and hold BLASTmedia and each of their respective parent companies, affiliates, subsidiaries, media partners, employees, Board Members and advertising, promotion, and other coordinating agencies involved in this Sweepstakes, and each of their respective officers, directors, and employees ("Promotional Parties") harmless from any and all liability whatsoever for any claims, costs, injuries, losses or damages of any kind sustained in connection with participation in this Sweepstakes or the use, acceptance, possession, awarding or participation of any prize-related activity or travel thereto. Sweepstakes is governed by the laws of the United States, and all participants hereby submit to the jurisdiction and venue of courts in Fishers, Indiana (Hamilton County) for resolution of all claims and disputes.
PRIVACY & OPT OUT MECHANISM: By entering the Sweepstakes and by registering at www.GPSTuner.com, participants will be sharing their personal information with Sponsor, and participants agree to Sponsor's use of participants' personal information as described in Sponsor's Privacy Policy located at http://www.blastmedia.com/gpstunersweetstakesprivacypolicy. INTERNET: The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. Any person who uses or attempts to use such means to enter the Sweepstakes will be disqualified from participation in the Sweepstakes and will be ineligible to receive a prize. If for any reason the Sweepstakes is not capable of running as planned, due to reasons including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend the Sweepstakes. In such case, Sponsor shall determine the winners in accordance with these rules from among all valid, non-suspect entries received prior to the event which warranted such action. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Promotional Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or for failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes.
CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATIONS OF LIABILITY: IN NO EVENT WILL PROMOTIONAL PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF ANY PARTICIPANT'S ACCESS TO AND USE OF INTERNET SITE WWW.GPSTUNER.COM OR THE DOWNLOADING FROM AND/OR PRINTING OF MATERIAL DOWNLOADED FROM SAID SITE. VT residents may omit return postage. All winner list requests must be received by November 15, 2010.
